This data protection declaration is intended to inform the users of this website regarding the type, scope and purpose of the collection and use of personal data by Sematell GmbH.

Sematell GmbH takes your data protection very seriously and treats your personal data confidentially and in accordance with legal regulations. We will revise this data protection declaration in the event of changes to this website or in response to other circumstances that make this necessary. The definitions of the terms used (e.g. “personal data” and “processing”) can be found in Article 4 of the General Data Protection Regulation (GDPR).

We use the terms found in the GDPR in our data protection declaration.

EU GDPR

Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data, the free movement of data and the repeal of Directive 95/46/EC (General Data Protection Regulation).

Personal data (Article 4 No. 1 GDPR)

‘Personal data’ means any information relating to an identified or identifiable natural person (hereinafter ‘data subject’). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Processing (Article 4 No. 2 GDPR)

‘Processing’ means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Controller (Article 4 No. 7 GDPR)

‘Controller’ means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

Consent (Article 4 No. 11 GDPR)

‘Consent’ of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

5. Collection of data

When you visit our website, personal data is also processed.

I. Collection of personal data

The IP address of the device you are using must be processed so that our web pages can be displayed in your browser. In addition, there is other information regarding your device’s browser.
We are obliged under data protection law to also guarantee the confidentiality and integrity of the personal data processed by our IT systems. The following data is logged:

  • The website visited
  • The time at the time of access
  • The amount of transmitted data in bytes
  • Source/referrer from which you reached the page
  • The browser used
  • The operating system used
  • The IP address used


The server log files are stored for a maximum of 7 days and then deleted. The data is stored for security reasons, e.g. to clarify cases of misuse. If data must be saved for reasons of evidence, it is excluded from deletion until the respective incident has been definitively clarified.
Data is also used to correct website errors.
The legal basis for this data processing is Article 6 (1) letter f) GDPR. Our “interest” in the sense of Article 6 (1) letter f) in the operation of this website is the implementation of the data protection goals of confidentiality, integrity and availability of the data.

II. Handling contact data

If you contact Sematell GmbH through the contact options that are offered, your personal details will be saved so that they can be used to process and answer your request. This information is voluntary and will not be passed on to third parties without your consent. To the extent that you voluntarily provide data to us, e.g. on forms, and this data is not necessary to fulfil our contractual obligations, we process this data based on the assumption that the processing and use of this data is in your interest. Here, the following data may be involved:

  • First name/Last name
  • Company
  • Phone number


Inquiries received via the contact form on our website are usually saved in our CRM system. The CRM system is regularly checked to see whether data can be deleted. If data relating to a customer or prospect relationship is no longer required, or if this is outweighed by an opposing interest of the customer, we will delete the data in question, provided that there are no statutory retention requirements.
The legal basis for this data processing is Article 6 (1) letter f) GDPR. Our “interest” in the sense of Article 6 (1) letter f) is communication with customers and commercial prospects.

III. Cookies

We use cookies on our websites. Cookies are small pieces of text information that are stored on your device by your browser. Cookies are required to enable certain functionality on our websites. On the one hand, we use session cookies, which are automatically deleted from your browser immediately after you have finished visiting our websites. We also use persistent cookies in the area of web analysis.

We process the aforementioned data in order to operate our website and to fulfil contractual obligations via-a-vis our customers. For inquiries from you when there is no active customer relationship, we process data for sales and advertising purposes. You can object to the use of your personal data for advertising purposes at any time.

 

7. Recipients/disclosure of data

Data that you provide to us will never be passed on to third parties. In particular, your data will not be passed on to third parties for their advertising purposes.
However, we may use service providers to operate this website or for other products we offer. In these instances, a service provider can sometimes obtain personal data. We carefully select our service providers – especially with regard to data protection and data security – and take all data protection measures required for permissible data processing.

 

8. Newsletter

You can also subscribe to an email newsletter on our website. In addition to the voluntary information on the respective form, we only process your email address. In order to subscribe to our newsletter, you must enter your email address on our newsletter form and submit the form by clicking on the “Register” button. We will send you confirmation via email once the data has been transmitted. This email contains a button that you must click to finalize the newsletter subscription (double opt-in).
In order to be able to send you a personalized newsletter with content tailored to your interests, we would be pleased to receive additional voluntary information about you.
The legal basis for this data processing is Article 6 (1) letter f) GDPR in conjunction with Section 7 UWG. Our “interest” in the sense of Article 6 (1) letter f is the administration and distribution of our news.


I. Revocation and termination
You can revoke your consent to receive the newsletter at any time and thus cancel the newsletter subscription. Once you cancel, your personal data will be deleted. Your consent to the newsletter email expires at the same time. You will find the link to cancel at the end of each newsletter.

11. Google Fonts

We use so-called Google webfonts on our website. Here, fonts are loaded from Google servers in order to improve website presentation. Data processing takes place based on a balance of interests, whereby our interest consists in an appealing design of the website.
The fonts in question are loaded from Google servers which are usually located in the USA. The appropriate level of data protection is guaranteed by Google  (list entry „Privacy Shield“).

 

12. Use of social media plugins

Due to our legitimate interest in the analysis, optimization and operation of our online services (within the meaning of Article 6 (1) letter f) GDPR), this website uses the Facebook social plugin, which is provided by Facebook Inc. Our registration service enables visitors to our website to learn more about our company, download content and provide their contact information and other demographic information. This information is stored on the servers of our software partner HubSpot. 17. Deletion of data

We generally delete personal data when there is no need for further storage. In the case of statutory retention requirements, deletion only comes into question once the respective retention obligation has expired.

Information on data processing in connection with Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited. If the party responsible for data processing on this website is located outside the European Economic Area or Switzerland, Google Analytics data processing is performed by Google LLC. Google LLC and Google Ireland Limited are hereinafter referred to as “Google”.

Google Analytics uses “cookies”, i.e. text files that are stored on the computer of the website visitor and that enable an analysis of the website visitor’s use. The information generated by the cookie about the use of this website by the website visitor (including the shortened IP address) is usually transmitted to a Google server and stored there.
